A drunken general manager from Denmark was found guilty by the Court of Appeal of groping a beach club waitress while she was explaining regulations of the beach club to his two friends. His three-month jail sentence was upheld.
The court also ordered ORS, 44, to pay a fine of Dh2,000 for consuming alcohol.
The court also upheld acquitting ORS of abusing GR and JH, two staffers of the club, with an expletive.
Criminal evidences reported that the club’s CCTV recording showed a man groping the waitress and a security guard rushing in and pushing him out.
The accused denied the molestation and assault charges but admitted to consuming alcohol when first appeared before the court.
According to the records, GD, 29, Macedonian waitress at a beach club, testified that while she was on duty at 6.30pm in July, the accused came with two other friends and wanted to book a table.
“While I was explaining to the accused the rules of the club, he was coming closer to me and I was moving back. I looked towards his other two companions and told them to make him understand. Taking advantage of the fact that I was busy talking with his friends, he walked to my back and groped me. I shouted and screamed at him. The security came and asked the three to walk out,” she testified.
APS, 32, Indian security guard testified: “The three men looked drunk so I continued observing them. They sat at a table without any prior booking as per the rules.
“The club’s official asked them to leave the place as they did not have a pre-booking of a table. They went to the swimming pool and ORS swam in his clothes. Again, the employee in charge of the swimming pool asked them to leave the place. Then they came and sat at one of the tables.
“The club’s official and the waitress went to them to explain the rules to them and to ask them to leave the club as they were violating the regulations. While the waitress was talking to them, I saw ORS stepping behind her and groping her.
“I rushed to her and pushed him out of the club as he was under the influence of alcohol and unable to control his behaviour. He resisted being pushed out. His friends apologised on his behalf,” he testified.
