No receivership in ex-minister's case

The Dubai Appeal Court – Commercial turned down an appeal of imposition of receivership on the company in ex-minister KBF’s case.

The court upheld the sentence of the First Instance Court – Commercial which had rejected imposing receivership request made by MFJ, the sister of the deceased Lebanese businessman.

The appellant's lawyer submitted the closing arguments on Wednesday [September 15] asking the court for imposition of receivership.

Whereas, defence lawyer Sameer Jaafar insisted in his closing argument that the sentence of the First Instance Court, which turned down the imposition of receivership case filed by the sister of the diseased Lebanese businessman, was correct as it was based on legal principles and explained them in details.

Jaafar closed his memorandum by requesting the court to turn down the appeal and uphold [confirm] the sentence of the First Instance Court, he told 'Emirates 24|7'.

In 1995, the Lebanese had set up a group of companies worth millions of dirhams, and as the law did not allow him 100 per cent ownership, he sought an Emirati's [former minister] help to find the legal mode to fully own the companies.

In addition to the group of companies, the businessman also had a building worth about Dh100m.

As the businessman died in 2005, the former minister had claimed he was a genuine partner and shared the money with the heirs of the diseased.

The heirs of the diseased represented by MFJ had filed a case claiming their full right in the company. In February 2008, the First Instance Court had sentenced KBF a suspended two years in jail, and on May 28, 2009, the Court of Appeals acquitted the ex-minister.

The Cassation Court also sentenced him a suspended one year jail as documents proved that KBF was never a partner and that his title in the licence was that of a service agent against an annual pay of Dh300,000, which was later increased to Dh600,000.

Based on the Cassation Court sentence, MFJ filed a case for imposition of receivership of the company.
